Desde a Constituição federal de 1988, o Brasil tem avançado, mesmo que vagarosamente, na construção de políticas públicas de inclusão de pessoas que se encontram em condições de desvantagem social. Dentre os movimentos sociais de luta, estão as pessoas com deficiência, seus familiares e profissionais de distintas áreas de atuação. Em agosto de 2021 o Ministro da Educação brasileira proferiu discursos que se engajam em atitudes excludentes. Dentre as falas mais polemizadas, afirmou que nas escolas há crianças com deficiência que (...) atrapalham o aprendizado dos demais alunos. O objetivo deste ensaio é discutir acerca dos discursos do Ministro como impactantes dispositivos de marginalização e exclusão social dos estudantes com deficiência. "We don't want inclusiveness": an (un)inspired essay by the Minister of Brazilian education Abstract: Since the Federal Constitution of 1988, Brazil has advanced, albeit slowly, in the construction of public policies for the inclusion of people who find themselves in conditions of social disadvantage. Among the social struggle movements are people with disabilities, their families and professionals from different areas of activity. In August 2021 the Brazilian Minister of Education delivered speeches that engage in exclusionary attitudes. Among the most controversial speeches, he stated that in schools there are children with disabilities who hinder the learning of other students. The objective of this essay is to discuss about the Minister's speeches as impacting devices of marginalization and social exclusion of students with disabilities. The content of the essay is supported by the documentary and legislative archive that underlies the history, emanation and implementation of public policies for inclusive education, as well as by authors who support the Human and Social Sciences in the understanding that the difference and the freedoms of Being and being in the world, with the world, with other people, being different, are non-negotiable human values. Francis Bacon's position on the existence of void and its nature has been mostly studied with regard to his views on the atom. This approach is undoubtedly right, but it disregards further topics related to Bacon's account of void, namely the world system and the transmutation of bodies. Consequently, a more comprehensive study of Bacon's view on vacuum seems desirable where all the contexts are taken into account. To address this desideratum, the present paper examines Bacon's different views on vacuum (...) drawing attention to the various contexts of the discussion. It also gives an evaluation of the arguments put forward in support of his positions. The first section presents a reconstruction of Bacon's consecutive positions and the reasons for his changes of mind. The second section lists the experimental facts traditionally cited in debates about vacuum and Bacon's interpretation of these. The final section evaluates the role that these experimental facts played in Bacon's arguments. As a result, it is shown that Bacon fits entirely into the general pattern of the early seventeenth century. Empirical arguments by themselves had little value for solving the question of the void; it was also necessary to have a formerly established theory. (shrink)

The exact nature of the relation between science and Scripture in the thought of Francis Bacon is a well-studied but controversial field. In this paper, it is shown that Bacon, though convinced that there exists no enmity between the book of God's wisdom and the book of God's power, usually tries to separate knowledge acquired by reason from knowledge acquired by faith. In his exposition of the principle of the conservation of matter, however, Bacon seems to find himself constrained to (...) invoke Scriptural truths in a manner that he usually disapproves of. In order to establish this principle, which is so essential to his overall scientific program, he appeals both to the Bible and Greek mythology in a way that points to certain conceptual tensions within his natural philosophy. Schwichtenberg showed that the System T definable functionals are closed under a rule-like version Spector’s bar recursion of lowest type levels 0 and 1. More precisely, if the functional Y which controls the stopping condition of Spector’s bar recursor is T-definable, then the corresponding bar recursion of type levels 0 and 1 is already T-definable. Schwichtenberg’s original proof, however, relies on a detour through Tait’s infinitary terms and the correspondence between ordinal recursion for α < ε₀ and primitive recursion over (...) finite types. This detour makes it hard to calculate on given concrete system T input, what the corresponding system T output would look like. In this paper we present an alternative (more direct) proof based on an explicit construction which we prove correct via a suitably defined logical relation. We show through an example how this gives a straightforward mechanism for converting bar recursive definitions into T-definitions under the conditions of Schwichtenberg’s theorem. Finally, with the explicit construction we can also easily state a sharper result: if Y is in the fragment Tᵢ then terms built from BR^ℕ,σ for this particular Y are definable in the fragment T_i+max{1,level(σ)}+2. This paper describes a project that consisted of translation conception in the theoretical vision and the available advent in the Internet, the automatic translation. In the establishment of a practical methodology of exercises translated with the dictionary and the automatic translator. Finishing, it diagnosised the necessary requirements with the Letters Course students in the Universidade Estadual do Sudoeste da Bahia, as previous structure knowledge of the English language and the time and author context. These resources, automatic translators added the previous (...) knowledge made possible the optimization of the time in the process of the English texts translation. (shrink)

Studying early modern medico-legal testimonies can enrich our understanding of witnessing, the focus of much research in the history of science. Expert testimonies were well established in the Roman Canon law, but the sphere of competence of expert witnesses—one of the grounds on which seventeenth-century physicians claimed social and intellectual authority—troubled contemporary jurists. By reconstructing these debates in Counter Reformation Rome, and by placing in them the testimonies given by Paolo Zacchia, one of the founding fathers of legal medicine, this (...) article discusses the epistemological and social issues surrounding the definition of expertise about the body in court. It shows how a high-ranking expert witness would define his competence versus the legal authority on the one hand, and versus lay and lower-status expert witnesses on the other. But it also explores the interactions between specific legal constraints, for example about eye witnessing, and the ways in which different kinds of witnesses would use the body as a source of evidence for testimony. The issue of whether the writings of Thomas Aquinas show internal contradictions has not only stirred readers from his earliest, often critical, reception, but also led to the emergence of a literary genre that has crucial relevance to the history of medieval Thomism. Concordances were drawn up which listed Thomas' contradictory statements and, in most cases, tried to disguise the appearance of contradiction by exegesis. But what was at stake in this interpretive endeavor? What role did the concordances play in (...) shaping Thomism? What tensions did they reveal in the works of Thomas? The book aims to investigate these questions and puts the concordance of Peter of Bergamo (1482), which represents the most important example of this type of text, at the center of the investigation. Dieses Buch untersucht, was in den jeweiligen Theorieansätzen mit Bildhandeln‹ gemeint ist, indem eine Reihe von philosophischen und kunstwissenschaftlichen Ansätzen zum Verhältnis von Bild und Handlung vorgestellt und systematisiert werden. Vier paradigmatische Handlungstypen werden voneinander differenziert, die spezifische Verwendungsmöglichkeiten von Bildern umfassen. Die ersten zwei – Bildspiele‹ und Bildakte‹ – beruhen auf der sprachphilosophisch motivierten Prämisse, dass die Verwendung von Bildern der Struktur eines Sprachspieles oder eines Sprechaktes entspricht. Diese Prämisse bezieht sich auf Verwendungsweisen, durch die materiellen Gegenständen der Bildstatus (...) zugeschrieben wird. Demgegenüber werden zwei weitere Bildhandlungstypen vorgestellt, wonach Bilder nur dann verwendet werden können, wenn ihr Bildstatus bereits feststeht. The Scottish Enlightenment shaped a new conception of history as a gradual and universal progress from savagery to civil society. Whereas women emancipated themselves from the yoke of male-masters, men in turn acquired polite manners and became civilized. Such a conception, however, presents problematic questions: why were the Americans still savage? Why was it that the Europeans only had completed all the stages of the historic process? Could modern societies escape the destiny of earlier empires and avoid decadence? Was there (...) a limit beyond which women's influence might result in dehumanization? The Scottish Enlightenment's legacy for modernity emerges here as a two-faced Janus, an unresolved tension between universalism and hierarchy, progress and the limits of progress. (shrink)

While a growing number of firms are being evaluated on environment, social and governance criteria by sustainability rating agencies, comparatively little is known about companies’ responses. Drawing on semi-structured interviews with companies operating in Italy, the present paper seeks to narrow this gap in current understanding by examining how firms react to ESG ratings, and the factors influencing their response. Unique to the literature, we show that firms may react very differently to being rated, with our analysis yielding a fourfold (...) typology of corporate responses. The typology captures conformity and resistance to ratings across two dimensions of firm behaviour. We furthermore show that corporate responses depend on managers’ beliefs regarding the material benefits of adjusting to and scoring well on ESG ratings and their alignment with corporate strategy. In doing so, we challenge the idea that organisational ratings homogenise organisations and draw attention to the agency underlying corporate responses. Our findings also contribute to debates about the impact of ESG ratings, calling into question claims about their positive influence on companies’ sustainability performance. We conclude by discussing the wider empirical, theoretical and ethical implications of our paper. (shrink)

This paper reports a European Forum for Good Clinical Practice workshop held in 2011 to consider a research ethics committee training syllabus, subsequent training needs and resources. The syllabus that was developed was divided into four competencies: committee working; scientific method; ethical analysis and the regulatory framework. Appropriate training needs for each, with possible resources, were discussed. Lack of funding for training was reported as a major problem but affordable alternatives were debated. Strengths and weaknesses of this approach were discussed (...) and the resultant proposal will be disseminated through the European Forum for Good Clinical Practice and the research ethics committees of member states. The relationship between power, law and consent is a key feature of the Western debate on criminal law. On the one side, defining the legitimate ways of exercising the punitive power has been a critical question since the Enlightenment thought onwards and especially as to the rule of law doctrine. On the other side, the role played by public punishment in shaping consent and its communicative potential have been crucial questions for critical, as well as non-critical approaches to criminal law (...) in contemporary thought. These questions gain in strength and radicalism when it comes to international criminal law (ICL). In this case the filter of the state is not present anymore to mediate between power, law and consent, and the power to punish individuals is directly exercised by international institutions. This means, on the one hand, that traditional justifications of the power to punish and which are elaborated on in the domestic sphere are not useful anymore in legitimating international punishment. International criminal norms are not framed by an international democratically elected parliament, and their exercise is not controlled by the complex system of checks and balances typical of the rule of law. On the other hand, having not being created by a sovereign, international criminal law cannot be conceived as an instrument to build or consolidate consent around the sovereign. A double-sided dilemma therefore arises: traditional explanations are no longer apt to answer the question whether ICL is legitimate, while ICL itself can no longer be considered an instrument to build consent around the traditional power exercising it, namely the state. Although I consider both sides of the dilemma equally interesting and stimulating, I will focus here only on one side of the coin: the ability to build consent of the ICL institutions, and in particular the International Criminal Court (ICC). In other words, instead of asking whether the consent around the ICC is broad enough for the Court to be considered legitimate, I shall ask whether the ICC is able to build consent around the world order it embodies. Can art, religion, or philosophy afford ineffable insights? If so, what are they? The idea of ineffability has puzzled philosophers from Laozi to Wittgenstein. In Ineffability and its Metaphysics: The Unspeakable in Art, Religion and Philosophy, Silvia Jonas examines different ways of thinking about what ineffable insights might involve metaphysically, and shows which of these are in fact incoherent. Jonas discusses the concepts of ineffable properties and objects, ineffable propositions, ineffable content, and ineffable knowledge, examining the metaphysical pitfalls involved (...) in these concepts. Ultimately, she defends the idea that ineffable insights as found in aesthetic, religious, and philosophical contexts are best understood in terms of self-acquaintance, a particular kind of non-propositional knowledge. Ineffability as a philosophical topic is as old as the history of philosophy itself, but contributions to the exploration of ineffability have been sparse. The theory developed by Jonas makes the concept tangible and usable in many different philosophical contexts. (shrink)

Much scientific research is characterized by a high degree of multidisciplinarity and interdependence between the experts. In these cases research may be described as a group activity, and as such analysed in terms of the intentions of the participants. In this paper I apply Bratman's notion of shared intentionality to explain the relations between social and epistemic elements in groups with a truth-oriented common goal. I argue that in truth-oriented activities the disposition to help – which is a constitutive part (...) of Bratman's notion of shared intentionality – takes the form of a commitment not to lie, and that mutual knowledge of this commitment gives the members an entitlement to rely on other members' testimonies. Thus, in truth-oriented group activities, common knowledge of the disposition toward mutual support gives epistemic relevance to cooperation. Scientific research is shaped by the coexistence of social and epistemic elements: social relations influence knowledge attributions, and the epistemic goal of the activity confers a particular character to these relations. This essay argues that despite of the feminist critique of Merleau-Ponty his phenomenology can be positively appropriated to the theory of sexual difference. It focuses on three issues: the first one is closely linked to the Phenomenology of Perception and introduces a concept of "difference as differentiation". The second one is concerned with the intersubjective dimension of sexuality and will be called a "sexual syncretism". Finally, I’m referring to Merleau-Ponty's notion of "chiasm" in his late work The Visible and the (...) Invisible in order to apply it to the theory of sexual difference. At this point, the difference between sexual beings will be conceptualized as "chiasmatic intertwining". In doing so, I hope to show that Merleau-Ponty's phenomenology is a helpful resource for philosophical research that is mainly concerned with the questions of sexuality and sexual difference. Pluralist mathematical realism, the view that there exists more than one mathematical universe, has become an influential position in the philosophy of mathematics. I argue that, if mathematical pluralism is true (and we have good reason to believe that it is), then mathematical realism cannot (easily) be justified by arguments from the indispensability of mathematics to science. This is because any justificatory chain of inferences from mathematical applications in science to the total body of mathematical theorems can cover at most (...) one mathematical universe. Indispensability arguments may thus lose their central role in the debate about mathematical ontology. (shrink)

Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. This article presents the first, systematic analysis of the ethical challenges posed by recommender systems through a literature review. The article identifies six areas of concern, and maps them onto a proposed taxonomy of different kinds of ethical impact. The analysis uncovers a gap in the literature: currently user-centred approaches do not consider the interests of a variety of other stakeholders—as opposed to just the receivers of a recommendation—in assessing the ethical impacts of a recommender system.

The existence of fundamental moral disagreements is a central problem for moral realism and has often been contrasted with an alleged absence of disagreement in mathematics. However, mathematicians do in fact disagree on fundamental questions, for example on which set-theoretic axioms are true, and some philosophers have argued that this increases the plausibility of moral vis-à-vis mathematical realism. I argue that the analogy between mathematical and moral disagreement is not as straightforward as those arguments present it. In particular, I argue (...) that pluralist accounts of mathematics render fundamental mathematical disagreements compatible with mathematical realism in a way in which moral disagreements and moral realism are not. 11. Trotz großer Verbesserungen in der Versorgung von Menschen mit Typ-1-Diabetes (MmT1D) werden auch bei hoher Motivation und hohem Wissensstand der T1D-Grundlagen und -Therapie die angestrebten Blutglukose-Werte häufig nicht erreicht. Daher hat sich aus der Gruppe der MmT1D und ihrer Angehörigen eine Gemeinschaft zusammengefunden, die auf Basis kommerzieller Technologien sogenannte Open-Source-Closed-Loop-Systeme (OSCLS) entwickelt, welche eine automatisierte Insulinabgabe ermöglichen. OSCLS haben das Potenzial, das Management der Erkrankung zu erleichtern und normnähere Blutglukose-Werte zu erzielen. Die OSCLS sind jedoch weder offiziell geprüfte noch zugelassene (...) Systeme. Aus dem Blickwinkel der Technikfolgenabschätzung untersucht die vorliegende Arbeit mittels leitfadengestützter qualitativer Interviews mit Nutzenden und Fachkräften vorrangig, warum sich die Nutzenden der OSCLS für die Systeme entscheiden und wie sich diese auf das Leben der Nutzenden sowie auf das Gesundheitswesen auswirken. Zudem ordnet diese Arbeit die OSCLS-Bewegung in vergleichbare aktivistische Bewegungen in Medizin und Gesundheit ein sowie in den Kontext der derzeit immer stärker werdenden Bewegung der Patient Innovation. Die Autorin Silvia Woll war als Geisteswissenschaftlerin seit 2015 als Mitarbeiterin am Institut für Technikfolgenabschätzung und Systemanalyse (ITAS) im Karlsruher Institut für Technologie (KIT) tätig. It is well-established that algorithms can be instruments of injustice. It is less frequently discussed, however, how current modes of AI deployment often make the very discovery of injustice difficult, if not impossible. In this article, we focus on the effects of algorithmic profiling on epistemic agency. We show how algorithmic profiling can give rise to epistemic injustice through the depletion of epistemic resources that are needed to interpret and evaluate certain experiences. By doing so, we not only demonstrate how (...) the philosophical conceptual framework of epistemic injustice can help pinpoint potential, systematic harms from algorithmic profiling, but we also identify a novel source of hermeneutical injustice that to date has received little attention in the relevant literature: epistemic fragmentation. Epistemic fragmentation is a structural characteristic of algorithmically-mediated environments that isolate individuals, making it more difficult to develop, uptake and apply new epistemic resources. This, in turn, can impede the identification and conceptualisation of emerging harms in these environments. We trace the occurrence of hermeneutical injustice back to the fragmentation of the epistemic experiences of individuals, who are left more vulnerable by the inability to share, compare, and learn from shared experiences. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. I argue that recent attempts to deflect Access Problems for realism about a priori domains such as mathematics, logic, morality, and modality using arguments from evolution result in two kinds of explanatory overkill: the Access Problem is eliminated for contentious domains, and realist belief becomes viciously immune to arguments from dispensability, and to non-rebutting counter-arguments more generally.

Public engagement is one of the fundamental pillars of the European programme for research and innovation _Horizon 2020_. The programme encourages engagement that not only fosters science education and dissemination, but also promotes two-way dialogues between scientists and the public at various stages of research. Establishing such dialogues between different groups of societal actors is seen as crucial in order to attain epistemic as well as social desiderata at the intersection between science and society. However, whether these dialogues can actually (...) help attaining these desiderata is far from obvious. This paper discusses some of the costs, risks, and benefits of dialogical public engagement practices, and proposes a strategy to analyse these argumentative practices based on a three-tiered model of epistemic exchange. As a case study, we discuss the phenomenon of vaccine hesitancy, arguably a result of suboptimal public engagement, and show how the proposed model can shed new light on the problem. (shrink)

La diffusione del libro nel Medioevo potrebbe essere riletta alla luce di una metafora attuale sebbene non scevra di aspetti dialettici: quella della “rete”. All’ubicazione spazio-temporale del libro nei monasteri medievali, contraddistinta da fisicità e permanenza, si sotituisce oggi un formato digitale e virtuale, che porta ad una sorta di decontestualizzazione e alla continuità del flusso di informazioni, contribuendo alla diffusione capillare del sapere. L’ottica di universalità e globalità accomuna tuttavia entrambe le epoche. Alcuni concetti-chiave dell’informatica potrebbero infatti declinarsi in (...) ambito medievale: Server-Client per la raccolta, la conservazione e la trasmissione delle conoscenze da parte dei monasteri, quali centri del sapere in Europa, agli uomini di cultura; Firewall , per alludere alla necessità di tutelare i manoscritti, mediante la copiatura e la diffusione dei codici; Community , ad indicare non solo la comunità religiosa o monastica in senso stretto, bensì l’apertura ad una costruzione del sapere mediante un’azione partecipativa . I problemi dell’autenticità delle fonti, dell’acriticità delle informazioni e la pratica delle citazioni trovano un precedente significativo nelle Sententiae di Pietro Lombardo: una sorta di “biblioteca virtuale” grazie alla collezione di passi dalla Sacra Scrittura e da fonti latine e greche, paragonabile a un moderno modello enciclopedico di sapere. The diffusion of the book in the Middle Ages could be critically read through a modern metaphor: the “net”. The space-temporal coordinates of the book shift from being physical and permanent in the Medieval monasteries, to being de-contextualized and continue in the flow of information of digital and virtual format. However the universal and global perspective is common to the contemporary and the Medieval periods. In fact some key-words of computer science could be applied to the Medieval context: Server-Client , for the collection, the preservation and the transmission of knowledge from monasteries, as cultural centers in Medieval Europe, to men of culture; Firewall , for the necessary protection of manuscripts, through copying and diffusing codes; Community , referred not only to the monastic and religious groups, but also to an open sharing of the building of knowledge. Problems like the authenticity of the sources, the lack of criticality in the reception of data, and the practice of quotations are well represented in Peter Lombard’s Sententiae : this work can be compared to a modern encyclopedia thanks to the collection of passages from the Holy Scripture and from Latin and Greek sources, as well as a “virtual library”. O artigo aborda a diáspora forçada de africanos ao Brasil por fatores econômicos, políticos, sócio cultural e psíquico, desencadeado por ações do FMI e Banco Mundial. O tratamento desumano que recebem, o crescente número de crianças e adolescentes invisibilizados que sonham com um imaginário de vida melhor no Brasil, como o “pais do futebol”, e/ou uma passagem provisória para chegar ao primeiro mundo em países considerados de colonização europeia como EUA ou Canada. O artigo provoca reflexões sobre a força da (...) historia sobre o psiquismo e saúde mental humana a partir do ideário de uma pedagogia colonialista que sustenta a hegemonia do mundo capitalista. From governments to the general public, one may ask about the possible contributions of historians, if any, to the understanding and management of global disasters, as e.g. the ongoing coronavirus disease 2019. Given the confuse situation at the onset of the pandemic in terms of diagnosis, treatment, and prevention, a look into past experience with nonconventional medicine seemed relevant. In the present study I surveyed secondary literature on the role of Chinese medicine, Āyurveda, and homeopathy over time. The quantitative results (...) were disappointing: nothing on Āyurveda, and one single study each on Chinese medicine and homeopathy. The quality of the former compensates for the numerical short age. The case of homeopathy is rather sui generis, since this medical system was born and blossomed during epidemics and pandemics. I conclude with a short comment on reference sources, which might serve as point of departure for future studies of Āyurveda in epidemics. (shrink)

High-quality arguments have strong and lasting persuasive effects, suggesting that people can distinguish high- from low-quality arguments. However, we know little of what norms people employ to make that distinction. Some studies have shown that, in evaluating arguments from consequences, people are more sensitive to differences with respect to the desirability of these consequences than to differences in the likelihood that these consequences will occur. This raises the question of whether people lack the criteria to distinguish high-quality from low-quality arguments (...) in support of such claims. In an experiment, 196 participants without any training in argument theory rated their acceptance of 30 claims about the likelihood that a certain outcome would result from a certain action. These claims were supported by an argument from authority, or from cause to effect, or from example. Arguments were systematically manipulated to violate nine specific criteria. For seven out of the nine criteria violation decreased acceptance of the claim supported. These findings show that people can use argument type specific criteria to distinguish high- from low-quality arguments. (shrink)
